Google just don't seem to be able to catch a legal break lately. Eric Goldman informs us of another Adwords lawsuit filed against the Search company by JTH Tax on April 4th. What's interesting about this one, is that it would appear that Google could have nipped the problem in the bud, but didn't...

JTH runs “Liberty Tax Service.” A company, “freeadvicecenter.com” runs an AdWords ad (the complaint does not specify what keywords triggered it) that has the title “Liberty Tax Service.” After a fruitless cease and desist letter to Google, JTH is suing Google for an injunction.

Eric goes on to say that JTH had sent C&D's to google, and points out that this is against their trademark infringement policy anyway, though they either didn't comply with the C&D's, or complied to late. The specifics are unknown.

You mean I coulda sued over this??

The exact same thing has happened to me on Overture, with a competitor placing ads with our name as the title. I guess I shoulda whipped out my lawyer a little sooner!
